The Child Protection Improvements Act of 2009
"We are fortunate to live in a country where millions of volunteers generously make time to participate in community service. But with so many volunteers working with children we need to ensure that child predators are not preying on innocent children through the guise of volunteerism. Children´s safety is paramount, and we need to make certain that those working with our youth have been thoroughly and properly screened," remarked by Rep. Adam Schiff, D-CA who passed the legislation today to Congress.
These times of economic downturn, businesses are not just the ones who are tightening belt in operational costs which includes employee salary. If the businesses could have a choice they would choose to hire volunteers instead of usual employees. But businesses that profit are sanctioned both by state laws and federal laws requiring them to pay for any worker that they hire. But non-profit organization is exempted from this law. Since, organization can only operate through donations and not direct trading; they cannot live to pay for more employees. Over the years, non-profit organization has been inculcating volunteerism to many Americans in support for their humanitarian causes. And during this time, volunteers are still up willing to lend a hand.
But the trend turned into a different track. Over the past decades, sexual offenders and predators have been widely reported to have been targeting schools, parks, and organizations to find their prey. These reports have been backed by several accounts from different state media outlets and the Department of Justice's records. In the website of the DOJ, statistics about sex offenders in the country has been published as one of the growing crimes in the United States with nonetheless lesser focus. The following are excerpt from the DOJ's page.
• On a given day in 1994 there were approximately 234,000 offenders convicted of rape or sexual assault under the care, custody, or control of corrections agencies; nearly 60% of these sex offenders are under conditional supervision in the community.
• Of the 9,691 male sex offenders released from prisons in 15 States in 1994, 5.3% were rearrested for a new sex crime within 3 years of release.
• Of released sex offenders who allegedly committed another sex crime, 40% perpetrated the new offense within a year or less from their prison discharge.
• Approximately 4,300 child molesters were released from prisons in 15 States in 1994. An estimated 3.3% of these 4,300 were rearrested for another sex crime against a child within 3 years of release from prison.
• Among child molesters released from prison in 1994, 60% had been in prison for molesting a child 13 years old or younger.
The proposed bill focused on conducting criminal background to all volunteers of non-profit organizations and other groups that has direct operations to children. This is to ensure that children's safety is advanced. While the said bill would pose a slow turn out in the number of people who would be volunteering, it is being supported by many organization as something as productive especially on the part of the children that they are helping.
The bill specifically will create a fast and reliable system to check on a person's background by creating a universal access to background system searches. The authors assure that the bill will not be too expensive on the part of the organization. Also, this bill mandates the organization to let the person searched see the report for fair judgment.
